Non-fault accidents

It was not your fault. That changes your options.

If someone else caused the accident, you are often in a stronger position than people realise — and rather less obliged to do what you are told than the first phone call from an insurer might suggest.

  • Your choice of repairer

You are generally not required to use the repairer your insurer proposes.

  • Replacement transport

A replacement vehicle can often be arranged, subject to your circumstances.

Some accident-related losses may be recoverable, depending on the case.

Detail

Written for someone dealing with this now. If you would rather just talk to us, the number is at the top of every page.

What non-fault actually means here

A non-fault accident is one where another party was responsible. Being hit from behind while stationary is the clearest example, but it also covers being hit while parked, being pulled into at a junction and a range of other situations where liability rests elsewhere.

It is not the same as you being certain it was not your fault. Liability is ultimately determined between the insurers on the evidence, which is why photographs, witness details and a prompt report matter so much.

You can usually choose who repairs your vehicle

When you report an accident, insurers commonly direct you towards their own approved repair network. In most cases you are not obliged to accept that, and you can have the vehicle repaired by a repairer of your choosing.

That matters if you would rather the work was done by people who will talk to you directly about what the repair involves, and who assessed the damage in the first place. It is your vehicle, and you are entitled to have a view about who works on it.

We would encourage you to check your own policy terms, since they vary, and to speak to us if you are unsure what your position is.

Costs that may be recoverable

Depending on the circumstances, a non-fault claim can extend beyond the repair itself. Recovery, storage, the cost of replacement transport, damaged personal property, and losses such as loss of earnings may be recoverable as part of an eligible claim.

We can assist with pursuing those. What we cannot do is tell you they will be paid — that depends on the facts of your case and on the insurer involved. Anyone who guarantees you an outcome at this stage is telling you something they cannot know.

What we can do

Recovery, secure storage, a replacement vehicle where you are eligible and one is available, the repair itself, and the administration of the claim around all of it — coordinated by one team, so you are not the person joining up four companies who each have part of the story.

If anyone was injured, we can also refer you to our panel of personal injury specialists. We are not a law firm and we do not give legal advice, so injury matters go to people who do that properly.

Questions

Asked on this exact subject.

Will making a non-fault claim affect my no-claims discount?
That depends on your policy and on whether your insurer recovers its outlay from the other party. It is a question for your insurer, and worth asking them directly and early.
Do I have to use my insurer's repairer?
In most cases no — you can generally choose your own repairer. Policies vary, so check your terms, and speak to us if you would like help understanding where you stand.
What if the other driver was uninsured?
We can still arrange recovery, storage and repair. Uninsured driver cases follow a different route for recovering costs, so report it to the police and your insurer promptly and take advice on the claim itself.
